WHO IS QUALIFIED TO COMPLETE DECK &
BALCONY INSPECTIONS IN CA?

According to SB721, deck and balcony inspections must be performed by a certified independent inspector. This inspector should have adequate knowledge and experience to perform a thorough evaluation of balconies, decks, and other elevated exterior elements in buildings with three or more dwelling units. The inspectors are typically licensed architects, structural engineers, certified building inspectors, or general contractors who possess an “A,” “B,” or “C-5” license and at least five years of experience.

SB721 Inspection Requirements

The State of California has enacted Senate Bill No. 721 (SB721), a law that imposes stringent inspection requirements on multifamily buildings. As per the stipulations of SB 721, owners of buildings with three or more units are obligated to conduct periodic inspections. The purpose of these inspections is to ensure the structural integrity and safety of balconies, decks, and stairs, which are categorized as Exterior Elevated Elements (EEE).

This law was approved in September 2018 and mandates that all relevant inspections must be completed by January 1st, 2025. The inspection report, which needs to be submitted within 45 days of the property inspection, must clearly define the current condition of the EEE, specify the expected service life of the elevated element, and clarify expectations for maintenance and repairs.

BUILDINGS THAT ARE REQUIRED TO HAVE DECK INSPECTIONS

Under SB721, buildings required to have deck inspections include multifamily residential properties with three or more dwelling units. Properties exempt from SB721 inspection requirements include buildings with fewer than three multifamily units, condominiums (which are covered under SB326), developments, and apartment projects. Additionally, multifamily residential properties without any elevated exterior structures are also exempt.
